Terms and Conditions

1. Introduction

1.1 Purpose

These Terms and Conditions (“Terms”) govern your use of Dockside and the services provided by GlassDesk Labs LLC (“we”, “us”, “our”). These Terms establish the rules for using our software and services and create binding agreements between you and GlassDesk Labs LLC.

1.2 Acceptance

By clicking “Agree and Continue” at first launch, or by purchasing, downloading, or installing Dockside, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree, you must not use Dockside.

2. User Rights and Responsibilities

Users agree to use Dockside in accordance with applicable law and the terms of our End User License Agreement. Prohibited conduct includes:

Protecting your license key and any account credentials associated with your purchase is your responsibility. You agree not to share your license key with others, and you are responsible for any consequences of unauthorized access if you fail to keep your credentials secure.

3. Service Description

3.1 Overview of Services

GlassDesk Labs LLC provides Dockside, a desktop application that organizes web apps and sites into isolated workspaces. The Dockside application is sold as licensed software through our website.

3.2 Modifications

We reserve the right to modify, update, or discontinue features of Dockside as part of ongoing product development. Significant changes will be communicated through our website or release notes. We are not obligated to maintain backward compatibility indefinitely with any specific feature.

4. Payment Terms

4.1 Fee Structure

Users agree to pay the specified fees for our services. Payment is processed by our merchant of record, Lemon Squeezy. Accepted payment methods include major credit and debit cards (Visa, Mastercard, American Express, Discover) and Apple Pay. Card data is handled directly by Lemon Squeezy; GlassDesk Labs does not store or have access to payment card details.

4.2 Billing Policies

Dockside Pro is offered on an annual or monthly subscription basis. Billing occurs upfront for the chosen period: annually for annual subscriptions, monthly for monthly subscriptions. Free tier users are not billed.

The Pro subscription includes a 14-day free trial; you are not billed until the trial period ends and you elect to continue. Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through the customer portal link provided in your receipt email. Refunds are governed by our Refund Policy.

5. Privacy Policy Integration

5.1 Data Handling

We handle user data as outlined in our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information.

5.2 Cookies Usage

Our website does not set cookies for tracking, analytics, or advertising purposes. Cookies may be set by our payment processor (Lemon Squeezy) at the point of checkout, governed by their own privacy and cookie policies. The Dockside desktop application does not set browser cookies.

6. Intellectual Property Rights

6.1 Ownership

GlassDesk Labs LLC retains all rights, title, and interest in and to Dockside, including all intellectual property rights in the software, the heydockside.com website, the Dockside name, logos, and branding. Your purchase of a Dockside license grants you the rights described in our End User License Agreement; it does not transfer ownership of the software to you.

6.2 User Content

Dockside does not host, publish, or share user-generated content. All workspace data, session data, and other content created or stored within the Dockside application remains on your local device. We do not access, collect, or claim any rights to your content.

7. Termination and Suspension

We reserve the right to revoke or suspend a license for the following reasons:

Upon termination of your license, your access to Pro features will be revoked. The free tier of Dockside will remain available on your device unless the application is uninstalled. License revocations made due to fraud or terms violations are not eligible for refund.

8. Dispute Resolution

8.1 Resolution Methods

Before initiating any formal legal action, you agree to first contact us through the contact form on our website to attempt resolution. We commit to responding in good faith within thirty (30) days of receiving your initial notice. If the dispute cannot be resolved informally within ninety (90) days of your initial notice, either party may pursue legal action subject to Section 8.2.

8.2 Jurisdiction

These Terms and Conditions are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought in the state or federal courts located in New Mexico.
