1. Introduction
1.1 Purpose
These Terms and Conditions (“Terms”) govern your use of Dockside and the services provided by GlassDesk Labs LLC (“we”, “us”, “our”). These Terms establish the rules for using our software and services and create binding agreements between you and GlassDesk Labs LLC.
1.2 Acceptance
By clicking “Agree and Continue” at first launch, or by purchasing, downloading, or installing Dockside, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree, you must not use Dockside.
2. User Rights and Responsibilities
2.1 User Conduct
Users agree to use Dockside in accordance with applicable law and the terms of our End User License Agreement. Prohibited conduct includes:
- Reverse engineering or attempting to derive source code from the application
- Redistributing, sublicensing, or sharing license keys with others
- Using Dockside to violate the rights of any third party
- Attempting to bypass license verification or Pro trial restrictions
2.2 Account and License Security
Protecting your license key and any account credentials associated with your purchase is your responsibility. You agree not to share your license key with others, and you are responsible for any consequences of unauthorized access if you fail to keep your credentials secure.
You may use the Password Sign-In feature only with third-party sign-in credentials that belong to you or that you are authorized to use, and you remain responsible for the accounts you access through Dockside.
3. Service Description
3.1 Overview of Services
GlassDesk Labs LLC provides Dockside, a desktop application that organizes web apps and sites into isolated workspaces. The Dockside application is sold as licensed software through our website.
Dockside offers an optional Password Sign-In feature that, with your permission, uses a password you have saved in another application (such as Google Chrome) on your device to help you sign in to third-party applications and websites by filling a sign-in form. The feature is off by default and can be toggled or declined anytime during the onboarding setup step or via settings. Passwords are processed locally, used once, and never stored or transmitted. 3.2 Modifications
We reserve the right to modify, update, or discontinue features of Dockside as part of ongoing product development. Significant changes will be communicated through our website or release notes. We are not obligated to maintain backward compatibility indefinitely with any specific feature.
4. Payment Terms
4.1 Fee Structure
Users agree to pay the specified fees for our services. Payment is processed by our merchant of record, Lemon Squeezy. Accepted payment methods include major credit and debit cards (Visa, Mastercard, American Express, Discover) and Apple Pay. Card data is handled directly by Lemon Squeezy; GlassDesk Labs does not store or have access to payment card details.
4.2 Billing Policies
Dockside Pro is offered on an annual or monthly subscription basis. Billing occurs upfront for the chosen period: annually for annual subscriptions, monthly for monthly subscriptions. Free tier users are not billed.
Dockside installs with a 14-day free trial of all Pro features (the “Pro trial”). It requires no account and no payment details, and it is not a subscription: no billing relationship exists during the Pro trial, and you are never charged automatically when it ends. When it ends, Dockside continues working on the free tier. Pro subscriptions begin only when you complete a purchase, and billing starts at checkout.
Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time from the Account tab in Dockside, through the customer portal link provided in your receipt email, or by contacting us. Refunds are governed by our Refund Policy.
5. Privacy Policy Integration
5.1 Data Handling
We handle user data as outlined in our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information.
5.2 Cookies Usage
Our website does not set cookies for tracking, analytics, or advertising purposes. Cookies may be set by our payment processor (Lemon Squeezy) at the point of checkout, governed by their own privacy and cookie policies. The Dockside desktop application does not set browser cookies.
6. Intellectual Property Rights
6.1 Ownership
GlassDesk Labs LLC retains all rights, title, and interest in and to Dockside, including all intellectual property rights in the software, the heydockside.com website, the Dockside name, logos, and branding. Your purchase of a Dockside license grants you the rights described in our End User License Agreement; it does not transfer ownership of the software to you.
6.2 User Content
Dockside does not host, publish, or share user-generated content. All workspace data, session data, and other content created or stored within the Dockside application remains on your local device. We do not access, collect, or claim any rights to your content.
7. Termination and Suspension
7.1 Grounds for Termination
We reserve the right to revoke or suspend a license for the following reasons:
- Fraudulent payment
- Chargeback or payment reversal
- Sharing or distribution of license keys
- Reverse engineering or other violations of our End User License Agreement
- Use of the software for illegal purposes
7.2 Consequences of Termination
Upon termination of your license, your access to Pro features will be revoked. The free tier of Dockside will remain available on your device unless the application is uninstalled. License revocations made due to fraud or terms violations are not eligible for refund.
8. Warranty Disclaimer and Limitation of Liability
8.1 Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCKSIDE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. GLASSDESK LABS LLC MAKES NO WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DOCKSIDE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU BEAR THE ENTIRE RISK AS TO THE SELECTION, QUALITY, AND PERFORMANCE OF DOCKSIDE.
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLASSDESK LABS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE DOCKSIDE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.3 Limit on Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLASSDESK LABS LLC’S TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF THE FORM OF ACTION) ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF DOCKSIDE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR DOCKSIDE.
8.4 Relationship to the EULA
These provisions are intended to be consistent with, and to supplement, the warranty disclaimer and limitation-of-liability provisions of our End User License Agreement. Where both documents address the same subject, they should be read together to provide GlassDesk Labs LLC the fullest protection permitted by applicable law.
9. Dispute Resolution
9.1 Resolution Methods
Before initiating any formal legal action, you agree to first contact us through the contact form on our website to attempt resolution. We commit to responding in good faith within thirty (30) days of receiving your initial notice. If the dispute cannot be resolved informally within ninety (90) days of your initial notice, either party may pursue legal action subject to Section 9.2.
9.2 Jurisdiction
These Terms and Conditions are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought in the state or federal courts located in New Mexico.
By using our services, you acknowledge that you have read and agreed to these Terms and Conditions.
